Terms of Service

1. Who we are

Nemudoro ("we", "us") is a focus companion made to help people work and rest in a calmer rhythm. You can reach us at hello@nemudoro.com.

2. Agreeing to these terms

By using Nemudoro, on the website or through the Nemudoro Discord app, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Nemudoro.

You must be at least 13 years old to use Nemudoro, whether you sign in with Discord or with email. If you use Nemudoro through Discord, Discord's Terms of Service also apply to you.

3. Your account

You sign in with Discord or with a code sent to your email address. Nemudoro has no passwords, and never sees your Discord password. You are responsible for what happens under your Nemudoro account, and for keeping your Discord account and your email inbox secure. Your progress belongs to your Nemudoro account; you can add another way to sign in to it under Settings → Account.

4. Sleep Points and your companion

Sleep Points, streaks, stages and everything else you earn in Nemudoro are part of a game. They have no cash value, cannot be bought, sold or transferred, and are not your property. We may adjust them to fix a bug, to undo points gained by misuse, or when the game's rules change.

5. Conduct and fair use

Use Nemudoro respectfully and lawfully, including when you use it inside Discord alongside other people. We do not tolerate harassment, bullying, hate speech or discrimination of any kind. Please don't:

• use scripts, bots or other automation to run sessions or earn Sleep Points, or cheat in any other way;
• exploit bugs. If you find one, tell us at hello@nemudoro.com;
• attack, overload or probe Nemudoro, or try to get around its security or its limits;
• access another person's account or data;
• copy, download or redistribute Nemudoro's sounds, music or artwork outside the app;
• use Nemudoro for anything unlawful.

If you do, we may remove points, or suspend or permanently end your access.

6. What you enter

The only free text you give Nemudoro is the optional tag on a focus session (for example "thesis"). Please don't put personal or sensitive information in a tag. You keep any rights you have in it, and you let us store and show it back to you so the app can work.

7. Our content

Nemudoro's name, companion, artwork, text and code belong to us or to those who licensed them to us. The ambient sounds and music are licensed from their creators, and the music player credits each track's artist. You may enjoy all of it inside Nemudoro for your own personal use. You may not copy, extract or redistribute it.

8. Premium and payments

Nemudoro is free to use. Nemudoro Premium is optional: today it unlocks the premium painted rooms (Blossom Study, Paris and Lisbon), the premium soundscapes of the soundboard and three visual effects (cherry blossoms, fireflies and shooting stars), and the three Premium companions (Umbra the dragon, Tortie the Maine Coon and Domino the Dalmatian), and it will include premium features added later. The timer, Sleep Points, stages, streaks, quests, the story and your data controls stay free. Premium never changes how Sleep Points are earned.

Who sells it, and how you pay

Premium is sold by Iulian Virgil Oliveira Strut, who runs Nemudoro from Portugal (see the Privacy Policy). Payments are taken by Ko-fi, on Ko-fi's own terms, in euros. Monthly Premium is a Ko-fi membership. Lifetime and Early Supporter are paid once, as a one-off donation on Ko-fi of at least their price (€15 or €10); a donation of less, or one without a support code, is a thank-you and unlocks nothing. Put the support code from the Premium sheet in your message on Ko-fi (it may be private), so your payment reaches your companion. Later monthly payments from the same Ko-fi account, or from a Ko-fi account linked to the Discord account you sign in with, reach it by themselves. If a payment does not arrive, email us with your support code and we will attach it by hand.

Buying in Discord

Inside the Nemudoro Activity in Discord, the same tiers are sold through Discord, at the prices in US dollars above (Discord shows them in your own currency). Discord takes the payment, renews monthly Premium and handles refunds, under Discord's Terms of Service and its terms for paid features. What you buy in Discord reaches the Nemudoro account you sign in to with that Discord account, on the website too.

Monthly renewal and cancelling

Monthly Premium renews each month, on Ko-fi or in Discord, wherever you bought it, until you cancel it there. On Ko-fi each payment unlocks Premium for a calendar month, plus 3 days' grace in case a renewal is late; in Discord, Premium lasts as long as Discord says the subscription runs. When you cancel, Premium stays on until the end of the period you last paid for, and then ends. Ko-fi and Discord, not Nemudoro, hold your payment details and take each renewal.

Refunds

You can change your mind: ask for a refund within 14 days of any payment, for any tier, without giving a reason. For a payment on Ko-fi, email hello@nemudoro.com with your support code or the Ko-fi transaction id: we refund the full amount through Ko-fi to the way you paid. For a purchase in Discord, ask Discord for the refund (Discord takes and returns those payments); if you cannot get it there, email us. Either way, the membership that payment bought ends. After 14 days payments are not refundable, except where the law gives you a right to a refund (for example, if what you paid for does not work as described). Cancelling a monthly membership stops future payments; the current month is not refunded in part.

"For as long as Nemudoro runs"

Lifetime and Early Supporter last as long as Nemudoro itself is available, not for your lifetime or ours. If we decide to close Nemudoro, we will say so on nemudoro.com, on Ko-fi and in Discord at least 90 days before it closes. Anyone who bought Lifetime or Early Supporter in the 12 months before that notice can ask for a full refund until Nemudoro closes. Monthly Premium ends with the last month paid for, and we will stop taking renewals.

Limited places

Lifetime and Early Supporter are limited to 100 and 50 places. The Premium sheet counts every payment for them, on Ko-fi and in Discord. The Premium sheet stops offering a tier once its places are taken, but a payment already on its way, or a Discord purchase before we close the tier there, may take a few more places than the limit. If you buy one of those, it is honoured in full, like any other.

Your account and your membership

A membership belongs to the Nemudoro account it was paid for. When you join two accounts, it moves to the account you keep. Deleting your account ends any membership on it: it cannot be restored or moved to another account later. Deleting your Nemudoro account does not cancel a monthly membership on Ko-fi or in Discord: cancel it there too.

Changes to Premium

We may change what Premium includes, to improve it or keep Nemudoro running. If a change takes away more than a minor part of what you paid for, we will tell you in advance, and you may end your membership and ask for a proportionate refund. Price changes never apply to a payment already made; for monthly Premium, a new price applies only after we announce it and you choose to renew.

9. Availability and changes

We may change, pause or discontinue any part of Nemudoro, including the game's rules and point values. Closing Nemudoro as a whole follows the notice in section 8. We try to keep your progress safe but cannot promise it will never be lost.

10. No warranty

Nemudoro is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not guarantee that it will be uninterrupted, error-free or completely secure. It is a productivity and wellbeing aid, not medical or professional advice. The wellness suggestions during breaks (stretching, drinking water, resting your eyes, breathing) are optional. Skip any that are not right for you.

11. Limitation of liability

To the extent the law allows, we are not liable for any indirect or consequential loss, or for any loss of data, points or progress, arising from your use of Nemudoro. Nothing in these terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.

12. Ending

You can stop using Nemudoro at any time. To have your data deleted, see your rights in the Privacy Policy. We may suspend or end your access if you break these terms.

13. Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page. Continuing to use Nemudoro after an update means you accept the new terms.

14. Governing law

These terms are governed by the laws of Portugal. If you use Nemudoro as a consumer, this does not take away any mandatory protections you have under the law of the country where you live, and you may bring a claim in the courts there.
